Welcome to PBA – Gems & Jewelry (“we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website https://www.pbagemsandjewellery.com/ (the “Site”) and any purchases you make through the Site. By accessing or using the Site and/or placing an order, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Site.
- Use of the Site
1.1 Eligibility: You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use this Site or make a purchase.
1.2 Account Information: If you register an account, you agree to provide accurate, current and complete information and to maintain and promptly update your information. You are responsible for safeguarding your password and account, and you accept responsibility for all activities that occur under your account.
1.3 Prohibited Conduct: You agree not to misuse the Site (including the purchase processes) in any way that is unlawful or harms us, other users or third parties.
- Products & Descriptions
2.1 We strive to display product descriptions, images, weights, purities (diamond: cut, color, clarity & carat) and other attributes as accurately as possible. However, due to visual display variations (screen, device etc.), minor differences in color, texture, size or finish may occur.
2.2 All jewelry products may involve natural stones, hand-finishing or customization; these may result in slight variations.
2.3 Unless otherwise indicated, all product weights and purities are approximate. You agree that small tolerances are acceptable in fine jewelry manufacturing.
2.4 All our jewelry products will be supported with authentication certificates.
- Ordering & Payment
3.1 Because many items are made-to-order or customized for you, when you place an order it cannot be cancelled until it’s dispatched.
3.2 Prices: All prices are in Indian Rupees (INR) unless otherwise specified. Prices exclude applicable taxes and duties unless otherwise stated. We reserve the right to change prices at any time (including after you place your order) but changes will not affect any order after we have sent you an acceptance.
3.3 Payment: Payment must be made using the accepted payment methods listed on the Site. You represent that the payment method you use is yours and authorized for this transaction.
- Shipping, Delivery & Customs
4.1 Shipping: We offer free shipping within India (as stated on the Site). Estimated delivery times apply (for example: within India 7-15 working days) depending on product, customization and stock availability.
4.2 Custom Jewelry: If you order a made-to-order or customized item, the shipping/delivery time may be longer. We will notify you of expected timelines when you place the order.
4.3 International Orders & Customs: If you are ordering from outside India (if allowed), you are responsible for all customs duties, taxes, import fees or other charges under your country’s laws.
4.4 Risk & Title: Risk of loss or damage to items passes to you when we deliver them to the carrier. Title (ownership) passes to you when we have received full payment for the item(s).
- Returns, Refunds & Exchanges
5.1 If a product is defective or significantly not as described, you must contact us within [7 days] of delivery to request a return, refund or exchange. We may require photographic evidence and/or inspection before approving a return.
5.2 Jewelry worn, altered, resized or customized after delivery may not be eligible for return or refund.
5.3 Refunds, when approved, will be issued to the original payment method within a reasonable timeframe.
5.4 Buy Back Policy: The jewelry (gold, diamond or silver) can be returned to us any time with 80% of invoicing value, must be supported by proper documents (invoice, authentication certificate).
- Customization & Made-to-Order
6.1 If you request customization or a made-to-order item, the specifications (design, weight, stones, purities etc) will be agreed in writing (email or other record) prior to production.
6.2 Custom orders may have non-refundable deposits or cancellation charges to cover work already undertaken.
6.3 Once production has commenced (or materials sourced), cancellation may not be possible or may attract additional charges.
- Intellectual Property
7.1 All content on the Site (including text, images, product designs, logos, trademarks) is owned or licensed by us and is protected by applicable intellectual property laws.
7.2 You may not copy, reproduce, modify, distribute or create derivative works from our content without our prior written consent.
7.3 When you submit designs or customizations, you represent you have the rights to use or submit the design and that it does not infringe any third-party rights.
- Warranties & Disclaimers
8.1 We warrant that we have the right to supply the products, and that at the point of delivery they will conform to the agreed specification.
8.2 Except as expressly set out in these Terms, all other warranties (express or implied) are excluded to the fullest extent permitted by law—including any implied warranties of merchantability or fitness for a particular purpose.
8.3 We endeavor to keep the Site secure and free of viruses or other malicious code but we do not warrant that the Site or services will be uninterrupted, error-free or that defects will be corrected.
- Limitation of Liability
9.1 To the maximum extent permitted by applicable law, our total liability under or in connection with these Terms, the Site or any product you purchase shall be limited to the amount you actually paid for the relevant product(s).
9.2 In no event will we be liable for any indirect, incidental, special, consequential or punitive damages (including loss of profit, data or goodwill) even if we have been advised of the possibility of such damages.
- Privacy & Data Protection
10.1 Our Privacy Policy (available on the Site) describes how we collect, use, disclose and protect your personal information. By using the Site, you consent to our collection and use of your information as described in the Privacy Policy.
10.2 You acknowledge and agree that information you provide may be transferred to/from and stored in India (or other jurisdictions) and you consent to such transfers.
- Governing Law & Jurisdiction
11.1 These Terms and any dispute arising in connection with them or your use of the Site will be governed by and construed in accordance with the laws of India, and you agree to submit to the non-exclusive jurisdiction of the courts located in [insert city/state, e.g., Mumbai, Maharashtra].
11.2 If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
- Changes to These Terms
